Texas Child Pornography Lawyers

Smith County Computer Sex Crime Defense Attorneys

Have you been arrested for or are you under investigation for child pornography? The mere allegation of such charges can have devastating impacts on a person's life. Damage to your reputation within your community, prison time and registration as a sex offender for the rest of your life are just a few of the difficulties these charges can create.

Child pornography charges can result from:

  • Being sent pornography and not knowing it.
  • Downloading content that unknowingly contains child pornography.
  • Storing sexually explicit videos of children on an iPod, portable digital music player, web camera, or other electronic device.
  • Solicitation of a minor over the Internet, such as in a chat room.
  • Pornographic images loaded onto your computer by someone else and without your knowledge.
  • Possessing a book, magazine, periodical, film, videotape, or any other material that contains an image of child pornography.

Even if you only suspect that you may be under investigation, it is wise to contact a criminal defense attorney who has experience dealing with the specific challenges that child pornography charges present.

With the attention that these issues receive from the media and the fact that law enforcement agencies such as the FBI monitor online traffic and set up internet stings to capture those involved with child pornography, being proactive is the best way to deal with these types of charges.

Restitution in Child Pornography Cases

A new aspect to a child pornography charge is the possibility that you will be ordered to pay restitution to any child whose image was the subject of the charges. Under Fed Ct. 18 USC Sec. 2259 A, anyone who possesses, distributes or produces a pornographic image of a child will be ordered to pay restitution to that child for damages and costs related to the impact of his or her involvement.
